2. Purpose and Scope

These Terms and Conditions of Sale (hereinafter "Terms") govern all sales of audio software (VST3, AU, AAX plugins) made by Dreamware Audio through its website and payment platform Lemon Squeezy.

Any order implies unreserved acceptance of these Terms as well as the End User License Agreement (EULA) available at: https://dreamware.audio/eula

These Terms are accessible at all times on the website and shall prevail over any other version or contradictory document.

3. Products and Services

Dreamware Audio sells audio plugins as downloadable software, including:

  • Detuna (and other catalog products)

Each product includes:

  • A detailed description on the website

  • A license key activation system

  • Free lifetime updates

  • Email technical support

Format: Plugins are available in VST3, AU, AAX formats (depending on compatibility).
Compatibility: It is the buyer's responsibility to verify software compatibility with their operating system and Digital Audio Workstation (DAW) before purchase.

4. Pricing

Prices are displayed in USD (Unites States Dollar) ($) including all taxes (or applicable local currency).

Dreamware Audio reserves the right to modify its prices at any time. The applicable price is the one in effect at the time of order validation.

Prices include:

  • Software license (according to EULA terms)

  • Free lifetime updates

  • Email technical support

5. Order and Contract Formation

5.1. Order Process

  1. The buyer selects the product on dreamware.audio

  2. They click the "Buy" button and are redirected to the secure Lemon Squeezy platform

  3. They enter their payment information

  4. They validate their order

By validating their order, the buyer:

  • Acknowledges having read and accepted these Terms

  • Acknowledges having read and accepted the EULA

  • Declares having the legal capacity to make this purchase

  • Expressly accepts that contract execution begins immediately after payment (waiver of withdrawal right, see Article 7)

5.2. Order Confirmation

An order confirmation is sent by email to the address provided during payment. It contains:

  • Order summary

  • License key

  • Download and installation instructions

  • Support link

6. Payment

6.1. Accepted Payment Methods

Payment is securely processed by Lemon Squeezy, which accepts:

  • Credit card (Visa, Mastercard, American Express)

  • PayPal

  • [Other methods according to Lemon Squeezy configuration]

6.2. Security

All transactions are secured and encrypted.
Dreamware Audio does not have access to the buyer's banking data, which is processed exclusively by Lemon Squeezy(PCI-DSS certified payment processor).

6.3. Payment Validation

The contract is concluded and the license is issued upon payment validation by Lemon Squeezy.

7. Right of Withdrawal / Cancellation Policy

For EU customers:

According to applicable consumer protection laws, the right of withdrawal does not apply to digital content supplied on a non-tangible medium where execution has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal.

By validating your order, you expressly agree:

  • That software delivery begins immediately after payment

  • To waive your right of withdrawal

This waiver is evidenced by:

  • Clear notice during the purchase process

  • Immediate sending of the license key and download link

Therefore, no refund can be claimed after receiving the license key.

For non-EU customers:

Due to the nature of digital goods, all sales are final.
No refunds will be issued after the license key has been delivered, except as required by applicable law.

8. Delivery

8.1. Delivery Method

The product is delivered electronically:

  • License key sent by email

  • Software download link

Delivery is immediate upon payment confirmation.

8.2. Responsibility

It is the buyer's responsibility to:

  • Provide a valid email address

  • Check their spam/junk folder

  • Download the software within a reasonable timeframe

If the confirmation email is not received within 24 hours, the buyer must contact support: support@dreamware.audio

8.3. Download or Activation Issues

In case of technical difficulty (download, installation, activation), the buyer may contact technical support, which commits to responding within 48 business hours.

9. License and Intellectual Property

9.1. Nature of the Sale

Purchasing a Dreamware Audio product grants the buyer a personal, non-exclusive license to use the software, in accordance with the EULA terms.

The buyer does not become the owner of the software, but only acquires the right to use it within the framework defined by the EULA.

9.2. Copyright

All software elements (code, interface, sounds, algorithms, documentation) are protected by copyright and remain the exclusive property of Dreamware Audio.

Any unauthorized reproduction, representation, modification, distribution, or exploitation constitutes infringement subject to applicable copyright laws.

9.3. Activation and Number of Machines

Unless otherwise stated, each license allows software activation on up to three (3) machines owned by the buyer.

10. Updates and Support

10.1. Updates

The buyer receives free lifetime updates of the purchased software.

Updates are provided "as is" and may include:

  • Bug fixes

  • Performance improvements

  • New features

Dreamware Audio reserves the right to modify, improve, or discontinue certain features at its sole discretion.

10.2. Technical Support

Technical support is provided by email at: support@dreamware.audio
Response time: Maximum 48 business hours.

Support includes:

  • Installation and activation assistance

  • Technical problem resolution

  • Usage advice

Support does not cover:

  • Issues related to third-party hardware or software

  • Incompatibilities with unsupported configurations

  • In-depth software training

11. Warranties and Liability

11.1. Statutory Warranty (EU)

For EU customers, the buyer benefits from statutory warranty rights according to applicable consumer protection laws.

The product (software) must conform to its description and possess the advertised qualities.

In case of non-conformity, the buyer may request:

  • Product conformity (update, fix)

  • Failing that, a refund

11.2. Limitation of Liability

The software is provided "as is" and "as available".

Dreamware Audio does not warrant that the software:

  • Will operate without interruption or errors

  • Will be compatible with all systems or configurations

  • Will meet all specific buyer needs

Dreamware Audio shall not be held liable for:

  • Direct or indirect damages resulting from use or inability to use the software

  • Loss of data, profits, clientele, or any commercial loss

  • Incompatibilities with third-party hardware or software

In any event, Dreamware Audio's liability is limited to the amount paid by the buyer for the product in question.

11.3. Buyer's Obligations

The buyer agrees to:

  • Verify software compatibility with their system before purchase

  • Use the software in accordance with EULA terms

  • Regularly back up their data

  • Not circumvent protection and activation systems

12. Personal Data (GDPR / Privacy)

12.1. Data Controller

Dreamware Audio is the controller of personal data collected during the order.

12.2. Data Collected

The following data is collected:

  • First name, last name

  • Email address

  • Payment data (processed by Lemon Squeezy)

  • Machine identifier (Machine ID) for activation

12.3. Processing Purposes

Data is used for:

  • Order and license management

  • Software activation

  • Technical support

  • Sending updates (with consent)

12.4. Retention Period

Data is retained for the duration of the license validity, then archived in accordance with legal obligations (minimum 3 years for accounting data).

12.5. User Rights

In accordance with GDPR and applicable privacy laws, the buyer has the following rights:

  • Right of access, rectification, erasure

  • Right to restriction of processing

  • Right to data portability

  • Right to object

  • Right to lodge a complaint with supervisory authorities

Warning: Exercising the right to erasure may make it impossible to reactivate the software.

13. Termination and License Revocation

Dreamware Audio reserves the right to terminate or revoke a license in case of:

  • Violation of these Terms or the EULA

  • Fraudulent use (key sharing, piracy, etc.)

  • Attempted circumvention of technical protections

In case of termination, the buyer must immediately cease all use of the software and uninstall it from all devices.
No refund will be issued in case of termination for violation.

14. Website Intellectual Property

All elements of the dreamware.audio website (texts, images, videos, logos, sounds, structure) are protected by copyright and remain the property of Dreamware Audio.

Any unauthorized reproduction, representation, or exploitation is prohibited.

15. Force Majeure

Dreamware Audio shall not be held liable for any delay or non-performance of its obligations resulting from force majeure as defined by applicable law (natural disaster, war, riot, fire, strike, major computer failure, etc.).

16. Entire Agreement

These Terms, the EULA, and the Privacy Policy constitute the entire agreement between Dreamware Audio and the buyer.
No modification shall be binding except by written agreement between the parties.

17. Severability

If one or more provisions of these Terms are declared null or unenforceable, the other provisions shall retain their full force and effect.

18. Applicable Law and Jurisdiction

These Terms are governed by French law.

In case of dispute, and after seeking an amicable solution, the competent courts shall be those of Paris, France.
For international customers, disputes shall be governed by French law, with the option of resorting to alternative dispute resolution methods.

19. Dispute Resolution

For EU customers:

In accordance with EU consumer protection regulations, the buyer may use alternative dispute resolution in case of dispute:
